You may need your Trustworth LLC account to use some Trustworth LLC services, and you may be required to log in to the account and have a valid payment method associated with it.

We reserve the right to refuse service, terminate accounts, or remove or edit content if you violate applicable laws, these Terms of Use, or any other applicable terms, conditions, guidelines, or policies.

7. Reviews, Comments, Communications and Other Content

You may post reviews, comments, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. If you post customer comments, customer questions or answers, or any other content you have created for display on the Website (including any images, video or audio, together “Content”), you grant Trustworth LLC a non-exclusive, royalty-free, perpetual, irrevocable, fully sublicensable right to use, reproduce, modify, adapt, publish, perform, create derivative works from, distribute, make available, translate and adapt such Content throughout the world in any media you grant to Trustworth LLC. Trustworth LLC’s sublicensees may use the name that you submit in connection with such Content.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; and that use of the content you supply does not violate any applicable policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Trustworth LLC for all claims brought by a third party against Trustworth LLC that arise out of or relate to the content and materials you supply except to the extent any liability arises from our failure to properly remove the content when notified; the unlawful nature of the content arising out of, based on, or arising from the content you send to us. 8. Intellectual Property Claims

Trustworth LLC respects the intellectual property of others. If you believe that your intellectual property rights have been used in a way that raises concerns of infringement, please follow our Notice and Procedure for Submitting Claims of Infringement.

9. Trustworth Program Terms and Conditions

In addition to these Terms of Use, the terms herein apply to any software (including any updates or upgrades to the software and any related documentation) that we make available to you from time to time for your use in connection with the Trustworth LLC Services (“Trustworth LLC Software”).

10. Sanctions and Export Policy

You may not use any Trustworth LLC Service if you are subject to Palestinian sanctions or sanctions consistent with Palestinian law imposed by the governments of the country in which you use Trustworth LLC Services. You must comply with all Palestinian export, re-export or other restrictions that may apply to goods, software (including Trustworth LLC Software), technology and services. Nothing in these Terms of Use shall, or should be interpreted or construed to, induce or require Trustworth LLC or you to act in any way (including taking or failing to take any actions in connection with a Transaction) that is inconsistent with or punishable under any applicable Palestinian laws, regulations, rules or requirements.

11. Other works

Parties other than Trustworth LLC operate stores, provide services, or sell product lines on this Site. In addition, we provide links to the websites of affiliated companies and certain other companies. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their websites. Trustworth LLC does not assume any responsibility or liability for the actions, products, or content of any of these or any other third parties. When a third party is involved in your transactions, we may share information about you relating to those transactions with that third party. You should carefully review these privacy statements and other terms of use.

12. Role Trustworth LLC

Trustworth LLC allows third party sellers to list and sell their products on tw.ps. In each such case, this is indicated on the relevant product detail page. While Trustworth LLC helps facilitate transactions carried out in the Trustworth LLC marketplace, Trustworth LLC is neither the buyer nor the seller of the seller’s items. Trustworth LLC provides a venue for sellers and buyers to negotiate and complete transactions. Accordingly, the contract formed upon completion of a sale of third party products is between the buyer and the seller only. Trustworth LLC is not a party to this contract and assumes no responsibility arising from or in connection with it nor is it the agent of the seller. The seller shall be responsible for the sale of the products and for dealing with any buyer’s claims or any other issue arising out of or in connection with the contract between the buyer and the seller. Because Trustworth LLC wants the buyer to have a safer buying experience, Trustworth LLC provides the Trustworth LLC A-to-Z Guarantee in addition to any contractual or other rights.

13. Our responsibility

We will do our best to ensure that the availability of the Trustworth LLC Services will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. In addition, your access to the Trustworth LLC Services may occasionally be suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

Trustworth LLC will not be liable for (1) losses that were not caused by any breach on our part, or (2) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (3) any indirect or consequential losses that were not foreseeable to you and us when you began using the Trustworth LLC Services.

We will not be liable for any delay or failure to comply with our obligations under these Terms if the delay or failure is due to any cause beyond our reasonable control. This condition does not affect your statutory right to have the goods sent or services provided within a reasonable time or to receive a refund if the goods or services ordered cannot be supplied within a reasonable time due to a cause beyond our reasonable control.

14. Applicable law

These Terms shall be governed by and construed in accordance with the laws of the State of Palestine. In the event of any dispute, claim, difference or controversy arising out of, relating to or in any way connected with these Terms, including as may relate in any way to your use of any Trustworth LLC Service, any products or services sold or distributed by Trustworth LLC or through tw.ps, or the existence, validity, interpretation, performance, breach or termination and/or any dispute relating to any non-contractual obligations arising therefrom or in connection therewith (for the purpose of this Section, a “Dispute”) the Palestinian courts shall have exclusive jurisdiction to resolve such Dispute and each party submits to the exclusive jurisdiction of the State of Palestine. For purposes of this Section, you waive any objection to the Palestinian courts, on the grounds that they are an inappropriate or inconvenient forum for the resolution of any Dispute.

15. Service Modifications or Modifications to the Terms of Use

We reserve the right to make changes to any of the Trustworth LLC Services, policies, terms and conditions including these Terms of Use and Service Terms at any time. You will be subject to the terms, conditions, policies and terms of use in effect at the time you use the Trustworth LLC Services. If any of these Terms of Use are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

If you violate these Terms of Use and we take no action, we will still be entitled to exercise our rights and remedies in any other situation where you violate these Terms of Use.

17. children

We do not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use the Trustworth LLC Services only with the involvement of a parent or guardian.

Upon receipt of the Notice Form, we may take certain actions, including removing information or an item, all of which are without any admission of liability and without prejudice to any rights, remedies or defenses, all of which are expressly reserved. Furthermore, by submitting the Notice Form, you grant Trustworth LLC the right to use, reproduce, modify, adapt, publish, translate, create derivative works from, and display its content throughout the world in any media. This includes forwarding the Notice Form to parties involved in submitting the allegedly infringing content. You agree to indemnify Trustworth LLC for all claims brought by a third party against Trustworth LLC arising out of or in connection with the submission of the Notice Form.

Additional Terms for Trustworth LLC

Use of Trustworth Software. You may use the Trustworth Software solely for the purposes of enabling you to use and enjoy the Trustworth Services as provided by Trustworth, and as permitted by these Terms of Use, these Software Terms, and any Terms of Service. You may not incorporate any part of the tw.ps Software into your own software, compile any part of it with your own software, transfer it for use with another service, sell, rent, lease, loan, lend, distribute, sublicense, or assign any rights to the Trustworth Software in whole or in part. You may not use the tw.ps Software for any unlawful purpose. We may stop providing any Trustworth Software and may terminate your right to use any Trustworth Software at any time. Your rights to use the tw.ps Software will automatically terminate without notice from us if you fail to comply with any of these Software Terms, the Terms of Use, or any other Terms of Service. Additional third-party terms included with or distributed with certain Trustworth Inc. Software and specifically identified in the relevant documentation may apply to the Trustworth Inc. Software (or software incorporated with the Trustworth Inc. Software) and will govern the use of such software in the event of a conflict with these Terms of Use. All software used in any Trustworth Inc. Service is the property of Trustworth Inc. or its software suppliers and is protected by local and international copyright laws.

Use of Third Party Services. When using the Trustworth LLC Software, you may also use one or more third party services, such as your wireless carrier or mobile platform provider. Your use of these third party services may be subject to separate policies, terms of use, and fees of such third parties.

No Reverse Engineering. Unless expressly permitted by applicable mandatory law, you may not, and will not encourage, assist or authorize anyone else to copy, modify, reverse engineer, decompile, disassemble or otherwise tamper with the Trustworth Software, in whole or in part, or create any derivative works from or of the Trustworth Software.

Updates. In order to keep Trustworth Software up to date, we may provide automatic or manual updates at any time and without notice to you.

Terms of Sale

These Terms of Sale govern the sale of products to you by Trustworth LLC for the benefit of Trustworth LLC, an affiliate of Trustworth LLC. For terms relating to third party sales to you on tw.ps, please see Section 13 of the Terms of Use. We offer a wide range of Trustworth LLC services, and at times additional terms may apply. When you use a Trustworth LLC service (e.g. your profile, gift cards or Trustworth LLC mobile applications), you will also be subject to the terms, guidelines and conditions applicable to the Trustworth LLC service (“Terms of Service”). Please read these terms carefully before placing an order with Souq.com E-Commerce LLC. By placing an order with Trustworth LLC, you indicate your agreement to be bound by these terms.

1. Our contract

Your order is an offer to Trustworth LLC to purchase the product(s) in your order. When you place an order to purchase a product from Trustworth LLC, we will send you an email confirming receipt of your order and containing the details of your order (“Order Confirmation Email”). 2. Returns, Refunds and Ownership

Trustworth LLC does not take ownership of returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. 3. Warranty

Unless otherwise provided in any statutory regulation, Trustworth LLC offers a warranty of up to twelve (12) months on eligible products purchased in the State of Palestine. At Trustworth LLC’s discretion, this warranty obligation is limited to repair of the defective product or replacement of the defective part, or replacement or refund according to the price of the product at the time of repair or replacement. For selected products and in cases where the transaction takes place in Palestine and Trustworth LLC is the registered seller, warranty repairs will be performed through authorized service centers designated by Trustworth LLC. 4. Pricing and Availability

All prices are inclusive of applicable VAT.

We list availability information for the products we sell on the Website, including on each product information page. Other than what we say on that page or on the Website, we cannot be more specific about availability. While we are processing your order, we will notify you by email as soon as possible if any of the products you have ordered are not available and we will refund your money if you have been charged for those products.

Please note that unless otherwise stated on the website, delivery estimates are just that. Delivery times are not guaranteed and should not be relied upon as such.

Despite our best efforts, a small number of the items in our catalog may be mispriced. We will verify prices when processing your order. You can contact Trustworth Customer Service Center within 24 hours of receiving the product and inform them of the defect in the product, and you can exchange it within 14 days.

The concept of switching (switching to the same product or to another product)

Switch cases

1. If the customer receives a product that does not conform to the specifications listed on the website .

2. In case there is a breakage, defect or malfunction in the product upon receipt .

Items shipped from tw.ps can be returned within 24 hours of receipt of shipment in most cases. Some products have different policies or requirements associated with them.

Returns will only be processed if:

1. The product has been determined to be undamaged while in your possession.

2. The product is not the same as what was shipped to you.

3. The product must be returned in the same condition it was in when received (sealed/unopened if possible, with the original brand or manufacturer box or packaging, any user manual, warranty card and all accessories)

4. Items marked as “non-returnable” on the product detail page cannot be returned. However, in the unlikely event that a damaged, defective or incorrect product is delivered to you, we will issue a full refund or replacement, as applicable. We may contact you to confirm the product is damaged or faulty before issuing a refund/replacement. We reserve the right to collect or inspect the product to confirm the product is damaged or faulty before issuing a refund/replacement.

5. After the shipping company receives your item, it may take up to two weeks for us to receive and process your return. After your return is processed, it may take 5-7 business days for your refund to be processed.

6. If you do not want the product even though it has the same specifications as you requested and there is no defect or malfunction in it, the buyer will bear all delivery fees.

Note: In the event that customers are found to be abusing the return policy by excessive returns, returning items that are not in their original condition, or by canceling or not accepting orders placed, Trustworth reserves the right to warn and/or restrict, suspend, block and/or terminate such customer accounts, as necessary.

Note: We will not accept returns of any product that was sent to us incorrectly or any product that is different from what was delivered to you. This includes items that were not originally purchased from Trustworth. If we receive such items, we cannot return or provide a refund or other benefit with respect to such items and your actions may result in restrictions on your Trustworth account including limiting your ability to return items in the future, canceling your order and/or closing your Trustworth account. Any product you send or return to Trustworth cannot be shipped or returned to you. We can only process returns for correct items that are returned in accordance with our policies.
